Photography Terms & Conditions
These Terms & Conditions apply to all photography services provided by Diana Tamarova Photography.
By booking a photoshoot and paying the booking fee, the Client confirms that they have read, understood, and agreed to these Terms & Conditions.
1. Definitions
Photographer refers to Diana Tamarova Photography.
Client refers to the person booking and paying for the photoshoot.
Booking fee refers to the payment required to reserve the agreed date and time for the photoshoot.
Photoshoot refers to the photography service agreed between the Photographer and the Client.

2. Booking and Agreement
A booking is considered confirmed once the required booking fee has been received.
The booking fee secures the agreed date and time exclusively for the Client. Until the booking fee has been paid, the date remains available for other enquiries.
By confirming the booking, the Client enters into an agreement with Diana Tamarova Photography and agrees to these Terms & Conditions.
The Client is responsible for providing accurate contact details and any relevant information required for the photoshoot.

3. Booking Fee and Payments
A booking fee is required to reserve the photoshoot date.
The remaining balance must be paid no later than the day of the photoshoot, unless otherwise agreed in writing.
Payment can be made using the available payment methods provided by the Photographer.
If the remaining balance is not paid on time, the Photographer reserves the right to apply a late payment fee of 10% of the total photoshoot price starting from the second day after the payment due date.
The Photographer may withhold delivery of the final gallery until all outstanding payments have been received in full.

4. Cancellation by the Client
The booking fee is paid to reserve the Photographer’s time, secure the agreed date, and compensate for potential loss of other booking opportunities.
If the Client cancels the photoshoot, the booking fee is generally non-refundable, as the Photographer has reserved the date exclusively for the Client and may have declined other enquiries for the same time slot.
If cancellation occurs due to exceptional circumstances, the Photographer may consider a refund or alternative solution at their discretion.
The Client is encouraged to contact the Photographer as soon as possible if they need to cancel or reschedule.

5. Rescheduling
The Client may request to reschedule the photoshoot.
One rescheduling request is allowed without losing the booking fee, provided that the new date is available and takes place within 12 months of the original booking date.
Additional rescheduling requests may require a new booking fee.
If the Client does not reschedule within the agreed period, the booking will be considered cancelled.

6. Cancellation or Unavailability by the Photographer
In the unlikely event that the Photographer is unable to attend the photoshoot due to illness, emergency, or circumstances outside of reasonable control, the Photographer will offer:
an alternative date, if possible; or
a refund of payments made if rescheduling is not possible.
The Photographer’s liability is limited to the amount paid by the Client for the photoshoot.

7. Weather Conditions
Outdoor photography is dependent on weather conditions.
Cloudy weather, light rain, wind, or changing weather conditions are considered normal and do not automatically require rescheduling.
Rescheduling due to weather will only be considered in cases of severe conditions, such as heavy continuous rain, storms, or unsafe weather conditions that would significantly affect the photoshoot.
The decision to reschedule will be made together by the Photographer and the Client.
The final decision regarding weather-related changes will usually be made close to the photoshoot date or on the morning of the session, depending on the circumstances.

8. Arrival and Delays
Clients are expected to arrive on time at the agreed meeting point.
Delays of up to 15 minutes are acceptable and will not impact the duration of the photoshoot.
If the Client arrives more than 15 minutes late, the missed time will be deducted from the session duration. This may result in fewer final images being delivered.
If the Client would like to extend the session due to a delay, upgrading to a longer package may be possible depending on availability.
If the Client is late and cannot be reached, the Photographer will wait for 15 minutes after the agreed start time. After this period, the session will be considered cancelled by the Client and the booking fee will not be refunded.

9. Artistic Style and Creative Approach
By booking a photoshoot, the Client confirms that they have reviewed the Photographer’s portfolio and understand and appreciate the Photographer’s artistic style.
The Photographer retains full artistic discretion regarding:
composition;
posing;
lighting;
location choices;
cropping;
editing style;
final image selection.
The Photographer will create images consistent with the style shown in the portfolio.
Each photoshoot is unique, and the final result may vary depending on weather conditions, lighting, location conditions, timing, and the Client’s interaction during the session.
The Photographer cannot guarantee specific poses, backgrounds, locations, or exact images shown in the portfolio.
Reference images may be used as inspiration, but the Photographer’s own creative style and professional judgement determine the final result.
Requests to significantly change the Photographer’s editing style, artistic approach, or recreate another photographer’s style are not included.
The Photographer does not provide complete re-editing of delivered images based on personal preference.

10. Client Expectations
The Client understands that photography is a creative service and that the final result depends on many factors, including cooperation, mood, weather, lighting, location, and natural interaction.
The Photographer cannot guarantee that every requested image, pose, or idea will be possible during the session.
The Client is encouraged to communicate important preferences or concerns before the photoshoot.

11. Location Conditions and Accessibility
Outdoor photoshoots take place in public locations and are subject to circumstances outside the Photographer’s control.
The Photographer is not responsible for temporary changes, restrictions, closures, or unexpected conditions, including but not limited to:
construction works or renovations;
closed streets, bridges, parks, or attractions;
temporary barriers;
blocked views;
public events;
markets;
crowds;
changes in accessibility.
The Photographer will make reasonable efforts to adapt the route, composition, or shooting plan when possible.
However, the Photographer cannot guarantee that every planned location or background will be available on the day of the photoshoot.
Such circumstances do not constitute grounds for a refund or cancellation.

12. Image Selection
The Photographer normally selects the final images delivered to the Client based on technical quality, emotional value, composition, and consistency with the Photographer’s artistic style.
The Photographer may exclude images containing:
technical issues;
closed eyes;
duplicates;
test shots;
unflattering expressions;
images that do not meet professional quality standards.
If the Client prefers to personally select the final images, this option can be arranged in advance.
In this case, the Photographer will provide unedited preview images, and the Client will choose the images to be professionally edited.

13. Editing and Retouching
The final images will be edited according to the Photographer’s standard editing style and according to the description of the selected package.
Editing includes professional color correction and retouching included in the selected package.
Additional retouching outside the package may require an additional fee.
Examples of additional editing include extensive changes to appearance, body modifications, background alterations, or significant image manipulation.
Once final images have been edited and delivered, the Photographer will not provide complete re-editing or change the editing style based on personal preference.

14. Delivery of Images
Final edited images will be delivered through an online gallery.
The expected delivery time is up to 5 weeks after the photoshoot.
The gallery availability period depends on the selected package and is usually between 1 and 3 months.
The Client is responsible for downloading and safely storing the delivered images during the gallery availability period.
After the gallery expires, the Photographer is not obligated to store or recover images unless an additional storage arrangement has been agreed separately.

15. Portfolio and Promotional Use
The Photographer reserves the right to use photographs taken during the session for professional and promotional purposes, including:
website;
portfolio;
blog;
social media;
printed promotional materials;
other professional publications.
If the Client prefers that their photographs are not published, this must be communicated to the Photographer before booking the photoshoot.
Private use of photographs without portfolio or promotional publication is available for an additional fee. The conditions will be agreed before booking.

16. Client Responsibility
The Client is responsible for:
arriving prepared and on time;
following reasonable instructions during the photoshoot;
informing the Photographer about any important circumstances that may affect the session.
Parents or guardians are responsible for the safety and behaviour of children during the photoshoot.
Clients bringing pets remain responsible for their pets’ safety and behaviour.

17. Safety and Conduct
The Photographer reserves the right to end a photoshoot without refund if the Client or any participant behaves in a threatening, abusive, unsafe, or inappropriate manner.
The Photographer may also refuse or stop activities that could put people, equipment, or the public at risk.

18. Force Majeure
The Photographer is not responsible for delays, cancellations, or inability to provide services caused by circumstances outside reasonable control, including but not limited to:
illness;
accidents;
transportation disruptions;
government restrictions;
extreme weather;
natural disasters;
other unforeseen events.
The Photographer will make reasonable efforts to offer an alternative solution where possible.

19. Limitation of Liability
The Photographer takes reasonable care to provide professional photography services and deliver high-quality images.
However, the Photographer cannot be held responsible for circumstances beyond reasonable control.
In any case, the Photographer’s maximum liability is limited to the total amount paid by the Client for the photoshoot.

20. Applicable Law
These Terms & Conditions are governed by the laws of the Netherlands.
Any disputes arising from these Terms & Conditions will be subject to the jurisdiction of the courts of the Netherlands.
